What are the qualifications required for an individual to apply for an EB-5 investor visa?

To apply for an EB-5 investor visa, an individual must meet the following requirements:

  1. Invest the requisite amount of capital: The applicant must invest at least $1.8 million ($900,000 if investing in a "targeted employment area" or TEA) in a new commercial enterprise. The investment must be made with personal funds and cannot be a loan. The investment must also create or preserve at least 10 full-time jobs for qualifying U.S. workers within two years of the applicant's admission to the United States.
  2. Source of Funds: The applicant must also demonstrate that the investment funds were obtained lawfully. Documentation must be provided to show that the funds were obtained through lawful means, such as through employment, inheritance, or sale of property.
  3. Business Plan: The applicant must submit a comprehensive business plan that outlines the nature of the investment, the management and organizational structure of the commercial enterprise, and the marketing and financial projections of the enterprise.
  4. Background Check: The applicant must pass a background check and provide biographic information, such as their passport, birth certificate, and other identity documents.

It is important to note that even if an individual meets these requirements, there are a limited number of EB-5 investor visas available each year. In addition, prior to investing any funds, it is recommended that an individual consult with an experienced immigration attorney to fully understand the requirements and potential risks associated with the EB-5 investor visa program.
