What types of visas are available for foreign entrepreneurs looking to start a business in the United States?

As a lawyer, I can advise that there are several types of visas available for foreign entrepreneurs looking to start a business in the United States.

  • E-2 Treaty Investor Visa: This visa is available for entrepreneurs from certain countries that have treaties with the United States. To qualify, the entrepreneur must make a substantial investment in a new or existing business in the United States and maintain control of the business. There is no set minimum investment amount, but the investment must be sufficient to ensure the success of the business.
  • L-1 Intracompany Transferee Visa: This visa is available for foreign entrepreneurs who own a business abroad and want to expand their operations to the United States. To qualify, the entrepreneur must have worked for the foreign business for at least one year in the past three years in a managerial, executive, or specialized knowledge capacity. The entrepreneur must also be transferring to a managerial, executive, or specialized knowledge position in the new U.S. office.
  • H-1B Specialty Occupation Visa: This visa is available for foreign entrepreneurs who have specialized knowledge in a certain field and want to start a business in that field in the United States. To qualify, the entrepreneur must have a bachelor's degree or higher in the specialized field or equivalent experience. The entrepreneur must also be employed in a specialized occupation related to the business.
  • O-1 Extraordinary Ability Visa: This visa is available for foreign entrepreneurs who have demonstrated extraordinary ability in their field, such as business, science, arts, or athletics. To qualify, the entrepreneur must have a high level of expertise in their field and have received national or international recognition for their achievements.

It is important to note that each visa has its own specific requirements and limitations, as well as potential exceptions and waivers. It is recommended that foreign entrepreneurs consult with an experienced immigration attorney to determine the best visa option for their individual situation and to ensure that they are in compliance with all legal requirements.
