# What steps do I need to take to terminate an employee in Ohio?

To terminate an employee in Ohio, an employer must follow state and federal laws that govern employment practices. Here are the steps an employer should take to terminate an employee in Ohio:

1. Verify Employment Status: Verify that the employee is an at-will employee. If the employee is an at-will employee, then the employer is free to terminate the employee at any time for any reason that is not illegal.
2. Follow Employee Handbook and Policies: Review the employee handbook and policies to ensure that the termination is in compliance with the company's policies and procedures.
3. Document Performance Issues: Document the employee's performance issues, including any warnings, reprimands, or disciplinary actions taken against the employee. Keep record of this documentation.
4. Provide Termination Notice: Provide the employee with notice of the termination. The length of notice must comply with any employment contract or collective bargaining agreement that applies.
5. Pay Final Compensation: Pay the employee all final compensation, including wages, salary, vacation pay, and any other unpaid compensation. This must be done in accordance with Ohio state law.
6. Comply with Final Paperwork Obligations: Provide the employee with any applicable paperwork, such as a final pay stub, COBRA notice, unemployment compensation information, and any other required documentation.

It's important to keep in mind that employees may have certain legal protections against termination, such as protection against discrimination, retaliation, or wrongful termination.
