# What kind of visa should I apply for if I am a foreign entrepreneur looking to start a business in the United States?

As a foreign entrepreneur looking to start a business in the United States, the appropriate visa to apply for would be the E-2 Treaty Investor visa. This visa is specifically for individuals or companies from countries that have treaties of commerce and navigation with the United States and who plan to make a substantial investment in a business in the United States.

To qualify for the E-2 visa, an applicant must first demonstrate that they have citizenship in a country that has an E-2 treaty with the United States. Additionally, the applicant must have invested a substantial amount of money that is at risk, meaning that it must have been committed to the business and not protected in any way.

Finally, the applicant must demonstrate that they will be able to direct and develop the business themselves, as they will also be required to have a controlling interest in the business. If the applicant meets these requirements, they may be eligible for the E-2 Treaty Investor visa.

It is important to note that there are some limitations to the E-2 visa. For example, the applicant must not intend to simply invest money and leave the business to be run by others. Additionally, the visa is not a path to permanent residency in the United States, although it can be renewed indefinitely as long as the business remains viable.

It may be useful for an aspiring entrepreneur to consult with an experienced immigration lawyer who can assist with the application process and advise on any specific issues that may arise.
