# What is the process for obtaining an employment-based visa in the United States as a skilled worker?

The process for obtaining an employment-based visa in the United States as a skilled worker typically involves several steps.

First, the employer must obtain certification from the U.S. Department of Labor (DOL) that there are no qualified U.S. workers available for the position being offered. The employer must also offer the foreign worker a wage that is at least the prevailing wage for similar jobs in the area.

Once this certification is obtained, the employer may file a petition with U.S. Citizenship and Immigration Services (USCIS) to sponsor the foreign worker for an employment-based visa. The employer must provide evidence of the worker's qualifications, including education and experience, and demonstrate that the position requires a person with specialized knowledge or skills.

If the petition is approved, the foreign worker may then apply for a visa at a U.S. consulate or embassy abroad. The foreign worker must provide additional evidence of their qualifications and admissibility to the United States, including a background check and medical examination.

If the visa is granted, the foreign worker may enter the United States and begin working for their sponsoring employer. However, the visa is typically only valid for a limited period of time, and the foreign worker may need to apply for extensions or pursue other legal options to remain in the U.S. beyond the initial duration of their visa.

It is important to note that the process for obtaining an employment-based visa can be complex and time-consuming, and there may be additional requirements or qualifications depending on the specific visa category and the foreign worker's individual circumstances. Additionally, there are quotas and limitations on the number of employment-based visas that can be issued each year, which may affect the availability of visas in certain categories or for certain countries.
