# What is the process for filing for bankruptcy in Florida, and what are the potential consequences?

The process for filing for bankruptcy in Florida involves several steps. First, the debtor must gather all of their financial information, including income, expenses, debts, and assets. This information will be used to determine whether the debtor is eligible for bankruptcy and which type of bankruptcy they should file.

The two most common types of bankruptcy are Chapter 7 and Chapter 13. In a Chapter 7 bankruptcy, the debtor's non-exempt assets are liquidated to pay off their debts. In a Chapter 13 bankruptcy, the debtor creates a repayment plan to pay off their debts over a period of three to five years.

To file for bankruptcy in Florida, the debtor must first complete credit counseling within 180 days of filing. They must then file a petition with the bankruptcy court in their area. This petition includes the debtor's financial information and lists all of their creditors and debts.

Once the petition is filed, an automatic stay is put in place, which prevents creditors from attempting to collect on the debtor's debts. The debtor is then required to attend a meeting of creditors, where they will be asked questions about their financial situation.

After the meeting of creditors, the debtor will need to complete a debtor education course before their bankruptcy can be discharged. If the debtor filed for Chapter 7 bankruptcy, their discharge will typically be granted within three or four months of filing. If they filed for Chapter 13 bankruptcy, their discharge will come at the end of the repayment period.

Potential consequences of filing for bankruptcy in Florida include damage to the debtor's credit score and the loss of non-exempt assets in a Chapter 7 bankruptcy. Additionally, not all debts can be discharged in bankruptcy, such as student loans and most tax debts.

It is important for debtors considering bankruptcy in Florida to speak with a licensed attorney who can provide detailed and accurate advice based on their specific circumstances.
