# What is the difference between a residential and commercial lease agreement?

As a lawyer, I can advise you that the main difference between a residential and commercial lease agreement is the intended use of the property being leased.

A residential lease agreement is a legal contract between a landlord and tenant(s) for the rental of a property that is intended for the tenant(s) to use as a dwelling. This type of lease usually includes provisions related to the payment of rent, maintenance responsibilities, security deposits, and terms of occupancy, among others. Residential leases may also be subject to local regulations regarding tenant rights and protections.

On the other hand, a commercial lease agreement is a contract between a landlord and tenant(s) for the rental of a property that is intended for commercial use, such as retail space, office space, or industrial properties. Commercial leases typically involve more complex terms and conditions than residential leases, which may include rent escalations, property maintenance obligations, and customizations of the premises for the specific needs of the tenant.

It is important to note that residential and commercial leases may also differ in legal requirements for their creation and enforcement, as well as in the remedies available when disputes arise. For example, commercial leases may often require that the tenant maintain certain insurance policies or that they agree to indemnify the landlord against certain types of legal claims.

In summary, the main difference between a residential and commercial lease agreement is the intended use of the property being leased. As such, it is important for both landlords and tenants to carefully review and understand the terms of any lease agreement they enter into.
