What documents do I need to prepare before selling my property?

As a lawyer, I can advise that when selling a property, certain documents must be prepared to ensure a successful transaction. Below are some of the essential documents that must be prepared:

  1. Title Deed: The title deed is a legal document that acts as proof of ownership of the property. Before selling the property, the seller must have the original Title Deed and ensure that there are no disputes or legal issues attached to it.
  2. Sale Agreement: The sale agreement is a legal document that outlines the terms and conditions of the sale. This document must be signed by both the buyer and the seller, and it must include the purchase price, payment terms, and any other important agreements between the two parties.
  3. Real Estate Agent Agreement: If a real estate agent is involved in the sale, an agreement must be prepared that outlines their commission and the scope of their responsibilities.
  4. Property Tax Clearance Certificate: The seller must obtain a property tax clearance certificate to prove that all taxes related to the property have been paid.
  5. NOC (No Objection Certificate): If the property is located in a co-operative housing society, the seller must obtain a NOC from the society before selling the property.
  6. Encumbrance Certificate: The encumbrance certificate is a legal document that certifies the property is free from any legal or financial liabilities.
  7. Completion Certificate/ Occupancy Certificate: If the property is a newly constructed property, the seller must have a Completion Certificate or Occupancy Certificate. It is proof that the building has been constructed in compliance with the regulations.
  8. Power of Attorney (POA): If the seller is selling the property on behalf of someone else, he/she should have a POA to prove that they have been given the authority to sell the property.
