To be eligible for an EB-5 visa, an individual must invest a minimum of $1.8 million in a new commercial enterprise or a regional center within the United States that creates at least 10 full-time jobs for qualifying U.S. workers. If the investment is made in a targeted employment area, which is usually a rural area or a location with high unemployment, the minimum investment is reduced to $900,000. Additionally, the investment must be made in a for-profit enterprise that is lawfully constituted, and that satisfies the requirements of the Immigration and Nationality Act. The enterprise can take various forms, such as a sole proprietorship, a partnership, a corporation, or a limited liability company. Furthermore, the investor must demonstrate that the funds used for the investment were obtained lawfully, and that the investment will create the required number of new full-time jobs for eligible U.S. workers. The investor must also file a *Form I-526, Immigrant Petition by Alien Entrepreneur*, and wait for approval before proceeding with the visa application process. If the petition is approved, the investor and their family members can apply for conditional permanent residency by filing *Form I-485, Application to Register Permanent Residence or Adjust Status*. Once the investor has met all of the requirements of the EB-5 program, they can apply for removal of the conditional status by filing *Form I-829, Petition by Entrepreneur to Remove Conditions*. It is important to note that potential investors should consult with a qualified attorney before proceeding with the EB-5 process to fully understand their eligibility, compliance requirements, and any limitations or exceptions that may apply to their specific situation.
