What are the requirements for obtaining an O-1 visa in the United States as a person of extraordinary ability in the field of science?

To obtain an O-1 visa in the United States as a person of extraordinary ability in the field of science, the applicant must meet certain requirements.

The O-1 visa is a nonimmigrant visa that allows individuals with extraordinary ability in science, arts, education, business, or athletics to enter the U.S. for a limited time to work in their field of expertise.

The applicant must demonstrate extraordinary ability in the field of science by satisfying at least three of the following criteria:

  1. Receipt of a major internationally recognized award, such as the Nobel Prize
  2. Membership in professional associations that require outstanding achievement in the field of science
  3. Evidence of published material in professional or major trade publications, newspapers, or other major media outlets about the applicant and his or her work in the field of science
  4. Evidence of participation on a panel, or individually, as a judge of the work of others in the field of science
  5. Evidence of original scientific contributions of major significance in the field of science
  6. Evidence of authorship of scholarly articles in the field of science in professional journals or other major media
  7. Evidence of employment in a critical or essential capacity for organizations and establishments that have a distinguished reputation in the field of science.

In addition to meeting the above criteria, the applicant must be sponsored by a U.S. employer, agent or consultant, have a written employment contract or agreement, and the duration of the proposed work in the U.S. must be temporary.

If the applicant meets the above requirements, he or she may apply for an O-1 visa. The applicant will need to file a Form I-129, Petition for Nonimmigrant Worker, along with supporting documents, and pay the required fees.
