Job Offer: The applicant must have a job offer from a US employer. 2. Specialty Occupation: The job offered must be a specialty occupation, which means that the job requires a specific and specialized educational degree in the same field. 3. Educational Background: The applicant must have obtained a bachelor's or higher degree from an accredited university in the same field as the job offered. 4. H-1B Cap: The applicant must also be subject to the annual H-1B cap, which limits the number of H-1B visas that can be issued each year. 5. Labor Condition Application: The employer must file a Labor Condition Application (LCA) with the Department of Labor. The LCA ensures that the employer will pay the H-1B employee at the prevailing wage rate and provide working conditions that are not less favorable than those of similarly employed US workers. 6. Petition Approval: The employer must file a Form I-129 Petition for Nonimmigrant Worker with the United States Citizenship and Immigration Services (USCIS). 7. Duration: The H-1B visa is typically granted for an initial period of three years, and can be extended up to a maximum of six years. It is important to note that the H-1B visa is a nonimmigrant visa, which means that it is temporary and does not provide a path to permanent residency or citizenship. Additionally, there are certain exceptions and limitations to these requirements, such as exemptions for certain organizations, individuals with advanced degrees, and petitions filed for certain government agencies.
