# What are the requirements and regulations for starting a non-profit organization in Texas?

To start a non-profit organization in Texas, you will need to follow certain requirements and regulations. These are as follows:

1. Choose a name for your non-profit organization – The first step is to choose a name for your organization that must comply with Texas state laws. Make sure that the name is unique, not already registered in Texas, and does not conflict with any existing trademark or service mark.
2. Select a board of directors – As per Texas laws, a non-profit organization must have a board of directors that will be responsible for governing and managing the organization. The board must consist of at least three members who are not related to each other or any paid staff member of the organization.
3. File articles of incorporation – To register a non-profit organization in Texas, you need to file articles of incorporation with the Texas Secretary of State's office. The articles of incorporation must contain a clear statement of purpose, the name and address of the non-profit organization, the name and address of the registered agent, and the names and addresses of the initial board members.
4. Obtain a tax ID number – To set up a non-profit organization, you will need to obtain a tax identification number (TIN) from the Internal Revenue Service (IRS). The TIN will be used to file tax returns and other financial reporting requirements.
5. Apply for tax-exempt status – After forming the organization and obtaining a TIN, you can then apply for tax-exempt status with the IRS. This will require completing IRS Form 1023 and submitting it along with the required documentation and fee.
6. File an annual report – Every non-profit organization in Texas is required to file an annual report with the Texas Secretary of State's office. The report must include the current address of the organization, the names and addresses of the board members, and any changes made to the articles of incorporation or bylaws.

It is essential to note that while these are the general requirements for starting a non-profit organization in Texas, certain exceptions or limitations may apply depending on the specific situation. Therefore, it is advisable to consult with a licensed attorney for further advice and guidance.
