Qualifications for an EB-1 Visa in the United States

To qualify for an EB-1 visa in the United States, an individual must be an alien of extraordinary ability, an outstanding professor or researcher, or a multinational executive or manager.

Alien of Extraordinary Ability

For individuals that are an alien of extraordinary ability, they must display exceptional ability in the sciences, arts, education, business, or athletics demonstrated by sustained national or international acclaim. To meet this requirement, the individual must provide evidence of receiving a major internationally recognized award in their field, or provide evidence of at least three of the following:

  • Receipt of lesser nationally or internationally recognized prizes or awards for excellence in their field.
  • Membership in associations in their field which require outstanding achievements.
  • Published material about them in professional or major trade publications or other major media.
  • Evidence of participation as a judge of the work of others in the field or related fields.
  • Evidence of original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field.
  • Authorship of scholarly articles in professional or major trade publications or other major media.
  • Display of their work at artistic exhibitions or showcases.
  • Performance in a leading or critical role for organizations or establishments with a distinguished reputation.

Outstanding Professor or Researcher

For individuals that are an outstanding professor or researcher, they must have international recognition as outstanding in their academic field. To meet this requirement, the individual must provide evidence of at least two of the following:

  • Receipt of major prizes or awards for outstanding achievements in the academic field.
  • Membership in associations in the academic field which require outstanding achievements.
  • Published material in professional publications written by others about the individual's work in the academic field.
  • Participation as a judge of the work of others in the same or allied academic field.
  • Original scientific or scholarly research contributions to the academic field.

Multinational Executive or Manager

For individuals that are multinational executives or managers, they must have been employed outside the United States in the three years preceding the petition for at least one year by a firm or corporation and must be seeking to enter the United States to continue service to that firm or organization.

It is important to note that meeting these qualifications does not guarantee approval of the EB-1 visa application. Other factors such as admissibility, availability of visas, and compliance with immigration laws and regulations may also impact the outcome.
