What are the qualifications needed to obtain an employment-based immigrant visa in the United States?

For example, in order to qualify for an EB-1 visa, the individual must demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim. They must also have a job offer in the United States and their employer must file a petition on their behalf.

Similarly, in order to qualify for an EB-2 visa, the individual must have a job offer in the United States that requires an advanced degree or exceptional ability in their field. They must also have a labor certification approved by the Department of Labor and their employer must file a petition on their behalf.

There are also limitations and exceptions to the qualifications needed for an employment-based immigrant visa. For example, some visas may have annual quotas, which limit the number of visas that can be issued each year. Additionally, certain individuals may be subject to additional requirements or restrictions, such as those with criminal records or health issues.
