What are the minimum wage requirements for employers in Pennsylvania?

In Pennsylvania, the minimum wage requirement for employers is $7.25 per hour. This is the same as the current federal minimum wage. However, employers who are subject to the jurisdiction of the Pennsylvania Minimum Wage Act (PMWA) and who have annual gross sales or business done of at least $100,000, or who employ at least one person for more than 40 hours per week, are required to pay a minimum wage of $12.00 per hour.

There are some exceptions to the minimum wage requirement. For example, there are certain classes of employees who are exempt from the PMWA, such as outside salespeople, certain commissioned employees, and employees of amusement or recreational establishments that do not operate for more than seven months in a year. Additionally, some employees may be paid less than minimum wage, such as those who are in training periods or apprenticeships, and certain disabled individuals.

Employers who violate the minimum wage requirement may be subject to penalties and legal action, such as fines and being required to pay additional wages to affected employees. In order to ensure compliance with the law, employers should regularly review their practices and consult with legal professionals to ensure they are meeting their legal obligations.
