# What are the legal requirements for establishing a non-profit organization in Florida?

# Legal Requirements for Establishing a Non-Profit Organization in Florida

To establish a non-profit organization in Florida, the following legal requirements must be fulfilled:

1. Select a Proper Name: The organization must select a name that is not already in use by another organization in the state of Florida. The name must also meet the requirements under Sections 617.0203 and 617.0204 of the Florida Statutes.
2. Draft and File Articles of Incorporation: The Articles of Incorporation must be filed with the Florida Department of State, Division of Corporations. The Articles must include the name of the corporation, the name and address of the registered agent, the purpose of the corporation, and any other provisions deemed necessary by the organization’s founders. A filing fee is also required to be paid to the Division of Corporations.
3. Obtain Recognition of Federal Tax-Exempt Status: The organization must obtain recognition of federal tax-exempt status from the Internal Revenue Service (IRS) by filing Form 1023 or Form 1023-EZ. This recognition is known as a 501(c)(3) exemption and enables the non-profit organization to receive tax-deductible contributions.
4. Register with the Florida Department of Agriculture and Consumer Services: Non-profit organizations that intend to solicit donations must register with the Florida Department of Agriculture and Consumer Services. This registration must be renewed annually.
5. Obtain Necessary Licenses and Permits: Depending on the nature of the organization’s activities, it may be required to obtain licenses and permits from federal, state, and local agencies. For example, a non-profit organization that provides healthcare services must obtain the necessary licenses and permits from the Florida Department of Health.

It is important to note that non-profit organizations are subject to federal and state laws and regulations, including tax laws, employment laws, and charitable solicitation laws. Failure to comply with these laws and regulations may result in penalties and revocation of tax-exempt status.
