What are the essential requirements for obtaining permanent residency in the US as an extraordinary ability individual?

As an extraordinary ability individual, there are several essential requirements for obtaining permanent residency in the US. These requirements are laid out by the United States Citizenship and Immigration Services (USCIS) and are designed to evaluate an individual's extraordinary abilities and determine if they qualify for permanent residency.

Requirements for Extraordinary Ability Individuals

To be considered an extraordinary ability individual, you must meet at least three out of ten criteria that demonstrate your extraordinary ability in your field of expertise. These criteria include:

  1. Receipt of nationally or internationally recognized prizes or awards in the field
  2. Membership in associations in the field that require outstanding achievements of their members
  3. Published material about the individual's work in professional or major trade publications or major media outlets
  4. Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field
  5. Authorship of scholarly articles in professional journals or other major media outlets
  6. Display of the individual's work at artistic exhibitions or showcases
  7. Leading or critical roles in distinguished organizations in the field
  8. High salary or other remuneration for services in comparison to others in the field
  9. Commercial success in the performing arts
  10. Other comparable evidence of extraordinary ability

After demonstrating your extraordinary abilities, you must also have a job offer from a US employer or have established yourself in the field of extraordinary ability in the US. This job offer or self-employment must be in the same field of expertise that was evaluated for extraordinary ability.

Finally, you must file an immigrant petition for alien worker with the USCIS and apply for a green card through either employment-based or self-petitioned means. The USCIS will evaluate your petition and determine if you meet all the necessary requirements for receiving a green card.

It is important to note that there are potential limitations and exceptions to obtaining permanent residency through the extraordinary ability route. For example, if you are unable to demonstrate your extraordinary ability through the ten criteria, you may not qualify for this particular route. Additionally, if you have certain criminal violations or health issues, you may be barred from obtaining permanent residency.

If you are unsure about your eligibility for permanent residency as an extraordinary ability individual, it is recommended that you consult with a licensed immigration attorney who can provide individualized legal advice based on your specific circumstances.
