What are the eligibility requirements for obtaining an O-1 visa as an individual of extraordinary ability in the field of science or technology?

To be eligible for an O-1 visa as an individual of extraordinary ability in the field of science or technology, the applicant must demonstrate sustained national or international acclaim and recognition for their outstanding achievements in their field. This can be done by providing evidence of any of the following:

  1. Receipt of a major, internationally recognized award, such as a Nobel Prize or equivalent.
  2. Membership in an association in the field that requires outstanding achievement as a condition of membership.
  3. Published material in professional or major trade publications or major media about the applicant, relating to their work in the field.
  4. Original scientific or scholarly contributions of major significance in the field.
  5. Authorship of scholarly articles in professional journals or other major media.
  6. Evidence of the applicant's participation as a judge of the work of others in the same or an allied field.
  7. Evidence of the applicant's original scientific or scholarly research contributions to the field.

The application must also include a consultation letter from a peer group or expert in the field, as well as any other supporting documentation or evidence of the applicant's achievements in their field.

There are no limitations or exceptions to these requirements, but it is important to note that the burden of proof lies with the applicant to demonstrate their eligibility for the O-1 visa. If the applicant is unable to provide sufficient evidence of their extraordinary ability in the field, they may not be approved for the visa.

If an applicant believes they may be eligible for an O-1 visa, they should consult with an experienced immigration attorney who can assist them in preparing their application and gathering the necessary documentation.
