# I am a business owner interested in hiring a highly skilled foreign worker. What are the requirements for obtaining an employment-based visa?

# Requirements for Obtaining an Employment-Based Visa

 As a business owner interested in hiring a highly skilled foreign worker, there are several requirements that must be met in order to obtain an employment-based visa. The most common type of employment-based visa is the H-1B visa, which is designed for professionals in specialty occupations.

 To obtain an H-1B visa, the company must first submit a petition to the United States Citizenship and Immigration Services (USCIS) on behalf of the foreign worker. The petition should include evidence that the company is offering a position that qualifies as a specialty occupation, and that the foreign worker possesses the necessary qualifications to perform the job.

## The following requirements must be met:

1. The job must qualify as a specialty occupation, meaning that it requires a minimum of a bachelor's degree or higher in a specific field of study.
2. The foreign worker must possess the necessary qualifications to perform the job, including a degree or equivalent experience in the specific field.
3. The employer must pay the foreign worker the prevailing wage for the job in the geographic location where the job is located.
4. The employer must be willing to sponsor the foreign worker for the H-1B visa, including paying the applicable fees.
5. The foreign worker must have a valid and non-expired passport.
6. The foreign worker must have no criminal record or history of violating immigration laws.
7. The foreign worker must not be otherwise inadmissible to the United States due to health, security, or other concerns.

 It's important to note that obtaining an H-1B visa can be a complex and time-consuming process, and there are limits to the number of visas that are available each year. In addition, there are some cases where certain exemptions or exceptions may apply, such as for individuals with advanced degrees or those who work in certain fields.

 If you are interested in obtaining an employment-based visa, it's important to consult with an experienced immigration attorney who can provide guidance on the specific requirements and processes involved.
